What is EPR and Why is it Mandatory for Importers?

Extended Producer Responsibility (EPR) is a policy instrument that makes manufacturers, importers, and brand owners (collectively 'producers') legally responsible for the end-of-life management of their products. In India, the Ministry of Environment, Forest and Climate Change (MoEFCC) has implemented EPR frameworks for three major waste categories: e-waste (electronic and electrical equipment waste), plastic waste (including single-use plastics and multi-layer packaging), and battery waste (portable, automotive, and industrial batteries).

For importers, EPR registration has become a mandatory pre-condition for customs clearance of regulated products. Indian Customs authorities — particularly at JNPT, Chennai, Tuticorin, and Delhi airports — are increasingly verifying EPR registration certificates during Bill of Entry assessment. Importers who cannot produce a valid EPR certificate for regulated product categories face customs detention, examination delays, and in some cases, refusal of clearance until EPR compliance is established.

The three EPR frameworks currently in effect in India are: E-Waste Management Rules 2022 (for EEE — electronic and electrical equipment including phones, laptops, TVs, ACs, refrigerators, and over 20 other product categories), Plastic Waste Management Rules 2016 (as amended in 2022, covering extended responsibility for plastic packaging), and Battery Waste Management Rules 2022 (covering all types of batteries). Each framework has its own registration portal, targets, and reporting requirements.

EPR Registration Process and Compliance Requirements

EPR registration for e-waste is done on the CPCB (Central Pollution Control Board) online portal. The application requires: the applicant's PAN, GSTIN, and business registration details; the specific product categories being imported (listed by CPCB-designated codes); annual import quantity estimates; details of the authorized collection and recycling agency or Producer Responsibility Organisation (PRO) engaged; and the EPR plan specifying how the producer will meet its collection and recycling targets. For plastic waste EPR, registration is made on the CPCB portal by brand owners and importers of plastic-packaged products. The EPR target is to collect and process a specified percentage (currently 70% to 90% depending on plastic type) of the plastic packaging sold or imported during the year. Compliance with EPR targets is demonstrated through EPR credits — certificates issued by CPCB-registered recyclers and processors — which producers must purchase or generate equivalent to their EPR target quantity.

Battery waste EPR registration requires producers and importers of batteries to register on the CPCB portal and arrange for end-of-life battery collection through an authorized collection agency or PRO. Annual EPR targets are specified as a percentage of the total battery quantity sold or imported.
